CORFU ROCK SCHOOL ACKNOWLEDGEMENT & ASSUMPTION OF RISKS RELEASE AND INDEMNITY AGREEMENT
Liability Release
This AGREEMENT, LIABILITY RELEASE AND ACKNOWLEDGEMENT and ASSUMPTION OF RISKS (“Release”) is given in the consideration of the services provided by Corfu Rock School LLC and it’s owners, officers, directors, employees, and agents (collectively Corfu Rock School), it extends to independent contractors, representatives, volunteers, included in this document, in allowing applicant to participate in the Corfu Rock School program. Applicant (“participant”) and his/her parent or guardian (“parent”) (collectively “we”) agree we have carefully read, fully understand and agree to be bound by this Release the terms and conditions contained in the Application process and guidelines above and the Corfu Rock School website. We agree to pay all participation fees. On behalf of myself, my heirs, executors, agents, assigns, and representatives, hereby indemnify, release and forever hold harmless Corfu Rock School LLC, as well as its directors, employees and instructors, from any and all claims of liability arising from any accident, personal injury, death, or property loss or damage sustained by my child/myself/ the minor child for whom I am a legal guardian, while that person is participating in activities connected with Corfu Rock School LLC., including classes, rehearsals, performances, or other activities. We understand that Corfu Rock School activities include inherent and other hazards, risks, dangers (collectively referred to in this document as “risks”) that can cause injury or other loss to participant or others associated with Corfu Rock School, both common and severe. Participant is voluntarily participating in Corfu Rock School activities with knowledge of the risks. We agree that Corfu Rock School representatives are and have been available to respond to any questions regarding these activities and the associated risks. Therefore, we agree to accept and assume the inherent and other risks, both known and unknown, and for any injury, damage, death, or other loss suffered by participant (and parents of minors) resulting from these risks and or resulting from participants negligence or other misconduct. In addition, I, the participates parent, for myself and for and on behalf of my participating minor agree to release Corfu Rock School and its contractors, listed in this release or otherwise, with respect to any and all claims, liabilities, suits, or expenses (claims), including claims resulting from Corfu Rock School’s or any contractors negligence (but not their gross negligence or wanton misconduct), for any injury, damage, death or other loss to me/my child in any way connected with me/my child’s enrollment, involvement, participation in Corfu Rock School activities, or use of equipment, facilities, or premises. “We” understand that we are required to have medical insurance for participant and we agree that we are solely responsible for covering all costs associated with any medical care and/or transportation, including airlift evacuation and related expenses. We authorize Corfu Rock School representatives, contractors or other medical personal to obtain medical care for me/my child including transportation to a medical facility. We agree that if we submit any electronic/digital forms, those are legally binding. We understand and agree that New York substantive laws will govern this Application and Release, any dispute that we have with Corfu Rock School, and all other aspects of our relationship with Corfu Rock School, and that any suit or other proceeding must be filed or entered into only in Rockland County, New York. As referenced above, we understand and agree that Corfu Rock School contracts with, and that this Release is intended to protect and include as additional released parties the following companies: Gelina Village Resort Hotel and Spa, Nikos Apartments Arillas, Olga’s Hotel, Marvelous Hotel, Arkokal Travel, Arillas Water Sports, National car hire, Olympic Palace, Corfelios Gmbh, Mariana Hotel, Horizon Hotel, Aquarius Bar, Thetis Arilla, Aqualand, Hydropolus Water Park, Corfu rock school UK ltd, We agree that this Release is binding upon us, our family members, heirs, executors, representatives, subrogors, and estate.
If any portion of this document is deemed unlawful or unenforceable it shall not affect the remaining provisions, and those remaining provisions shall continue in full force and effect.
ACKNOWLEDGEMENT & ASSUMPTION OF RISKS
INHERANT AND OTHER RISKS include but not limited to; risks present in outdoor environments – this includes travel on and off trail in rugged terrain; travel may be subject to hot weather; water; unstable terrain; venomous stinging animals or insects; other natural or man made hazards. Hazards may not be marked and weather may be unpredictable. Geographical location risks; activities may take place in remote locations causing potential delays in communication, transportation, evacuation, and medical care.Terms of Agreement
We agree to all aspects of the CORFU ROCK SCHOOL ACKNOWLEDGEMENT & ASSUMPTION OF RISKS RELEASE AND INDEMNITY AGREEMENT including the Liability Release, the Acknowledgement & Assumption of Risks and the Terms of Agreement. We grant permission for the participant to participate in all activities organized by or through Corfu Rock School and to use public and private transportation. We authorize Corfu Rock School to take and use participants/parents/guardians photo images, motion pictures, and or video recordings, audio recordings, written statements for promotional purposes without recourse by or compensation to us. We understand that Corfu Rock School reserves the right to dismiss any participant from the Corfu Rock School program that the staff believes, in their discretion, presents a safety concern towards themselves or others, is a medical risk, is disruptive, or otherwise conducts him or herself in a manner that is determined to be detrimental to the Corfu Rock School program and community. I acknowledge and accept that if my child or I is dismissed from the Corfu Rock School program for any reason, that no refunds can be granted. Parents or guardians are responsible for all costs related to early departure whether for medical reasons, dismissal, personal emergency or otherwise. We agree that there shall be no possession or use of the following: no possession or use of unauthorized prescription drugs or other controlled substances; no minor participant possession or smoking of any kind or use of smokeless tobacco; no minor participant possession or drinking of alcoholic beverages; no possession or use of marijuana or other illegal drugs or drug equipment/paraphernalia either on or off Corfu Rock School property. Violators will be removed from the program and sent home at their parents, guardians, participants expense. We agree that Corfu Rock School is not responsible for participants lost, stolen, or damaged property. Participates and their parents/guardian will be held responsible for damaged to or loss of Corfu Rock School or affiliates property or equipment.
Cancellations for medical reasons before the Corfu Rock School program begins must be accompanied by a letter from the attending physician and submitted for review at least eight (8) weeks prior to the start of the event.
